The idea that one couldn't get access to the source code in discovery is silly. They have nothing to lose by publishing it.

People who are going to sue them aren't going to be dissuaded by lack of initial source code access.



People who had no idea their IP was being infringed may sue once they get a look at the code.


Sorry, but it really just does not work that way in the patent world (copyright is a different story, but they have never made the claim they are worried about copyright infringement).

I can't even remember a case that started by someone looking at source code to figure out if their IP was being used.
